New York Asbestos Lawsuits

Asbestos is a harmful fiber that can trigger various serious medical conditions, such as mesothelioma. A New York asbestos attorney is adept at dealing with lawsuits that seek financial compensation for those who have suffered from asbestos exposure and their families. These cases can be complex and therefore it is essential to have an experienced mesothelioma lawyer on your side.

New York has a long history of asbestos litigation, and many residents have been exposed to this dangerous material. In recent years, there have been more lawsuits against former asbestos producers than ever before. These cases are the result of the recognition that asbestos is linked to illnesses such as mesothelioma or lung cancer. These companies knew of the dangers associated with the asbestos-containing mineral, yet they did not warn their employees and consumers.

New York City is especially vulnerable to illnesses caused by asbestos because of its old structures and many construction sites. Brooklyn Navy Yard is a notoriously hazardous area that continues to impact the surrounding community.

Many workers were exposed asbestos in their work environments. In addition, exposure to asbestos through secondhand sources can lead to mesothelioma. This includes spouses of asbestos-exposed workers who had their husbands' work clothes and came in contact with asbestos dust on a regular basis.

The litigation associated with mesothelioma is costly for defendants, especially if they are wrongfully named as defendants. According to an investigation, more than 3,600 claims have been filed in New York courts since 2014 and the number could increase even more. Specialized asbestos law firms often advertise on daytime TV and encourage victims to submit claims under the premise that they will receive significant settlements.

Defendants may be able to mitigate some of the costs associated with these cases by asserting that their policy periods expire or they are only responsible for a tiny percentage of the total value of the claim. New York law does not have a specific rule for how to divide responsibility when the alleged exposure is of the insurer's policies.

Asbestos-related Diseases

Exposure to asbestos can cause many different diseases. The condition known as mesothelioma is the most serious. Mesothelioma is the cause of death of many people. Other asbestos-related diseases include asbestosis and lung cancer. Pleural plaques and pleural effusion are also asbestos-related.

Mesothelioma is a rare, but fatal illness caused by exposure to asbestos fibers that accumulate in the lungs and irritate the lining of the ribcage, chest cavity, and abdominal cavity (the pleura). Inhaling these fibers can lead to scarring in the lungs. This is known as asbestosis. It can also cause thickened pleura patches (pleural plaques) or an increase in fibrosis. Pleural plaques and diffused fibrosis reduce lung capacity, as measured by breathing tests. They can also cause pain and difficulty in breathing, however they do not lead mesothelioma or cancer.

Symptoms of asbestos-related disease often don't manifest until decades after the initial exposure. This is because it could take between 20 to 50 years for the exposure to asbestos fibers to cause lung damage. Workers who handled, cleaned, and removed asbestos from their workplaces as well as spouses, children, and others exposed to asbestos are at risk for developing mesothelioma.

Other asbestos-related diseases in addition to mesothelioma include laryngeal cancer and lung cancer as well as peritoneal, ovarian and peritoneal cancer. Ovarian cancer is the deadliest mesothelioma that women suffer from however, it is much less prevalent than mesothelioma in general. It is diagnosed later than most other types of mesothelioma because it develops within the linings of reproductive organs. The symptoms can be similar to other illnesses.

A number of companies employed asbestos in the 20th century, but they knew that it was dangerous. If they didn't remove asbestos from their products thousands of people were exposed. They can now claim financial compensation. Many asbestos-related companies are bankrupt. As a result, the victims are able to seek the compensation they are entitled to from trust funds established by the bankruptcy courts.

A panel composed of six Supreme Court judges will review every case filed in NYCAL to decide whether or not to take it up with it. Judges will also assess the merits of each claim to determine how much the plaintiff's compensation should be.

The panel is currently studying more than 3,500 lawsuits. The panel is expected to issue its final ruling by the end of this year.
