Asbestos is a deadly fiber that can lead to various serious medical conditions, such as mesothelioma. A New York asbestos lawyer is skilled in dealing with asbestos lawsuits, which seek financial compensation for the victims and their families due to exposure to this toxic substance. These cases can be a bit complicated and it's crucial to have a mesothelioma lawyer on your side.

New York has a long history of asbestos litigation, and many residents have been exposed to this hazardous substance. In recent years, there have been more lawsuits against asbestos producers in the past than ever before. These cases are a result of the recognition that asbestos is associated with diseases such as mesothelioma and lung cancer. These companies were aware the dangers that asbestos posed however, they failed to inform the employees and the public.

New York City is especially vulnerable to illnesses caused by asbestos due to its old structures and construction sites. The Brooklyn Navy Yard was a notoriously toxic site that continues to impact on the surrounding community.

Mesothelioma is triggered by exposure to asbestos in direct contact and a lot of workers were exposed at work. However, many people are diagnosed with mesothelioma as a result of an exposure secondarily to the harmful substances. This includes spouses who wear their husband's clothes to work and come into contact with asbestos dust regularly.

The litigation associated with mesothelioma can be expensive for defendants, especially if they are wrongfully named as a defendant. According to a study, more that 3,600 lawsuits have been filed in New York courts since 2014 and the number could increase further. This kind of litigation is usually fueled by specialized asbestos law firms that advertise on television during the day and encourage victims to file claims with the promise of huge settlements.

Defendants might be able to mitigate some of the costs associated with these cases by asserting that their policy periods have expired or they are only responsible for a small portion of the amount of the claim. New York law does not provide a definitive rule on how to distribute the liability if the alleged exposure is of the insurance policies.

Asbestos-Related Diseases

A variety of asbestos-related diseases can develop due to exposure to the toxic mineral. The condition known as mesothelioma is the most serious. Many people have died from mesothelioma. Other asbestos-related diseases include lung cancer, asbestosis, pleural plaques and the pleural effusion.

Mesothelioma is a rare but fatal illness caused by exposure to asbestos fibers which accumulate in the lungs and irritate the lining of the ribcage, chest cavity, and abdominal cavity (the Pleura). The inhalation of these small fibers can cause scarring to the lungs, a condition known as asbestosis and sometimes the development of thickened patches on the pleura called plaques of pleura or an enlargement of fibrosis in the pleura, referred to as diffused pleural the fibrosis. Pleural plaques or diffuse fibrosis could reduce lung capacity as measured by a breath test. They can also cause pain and discomfort in breathing, but they do not lead mesothelioma or cancer.

Often, symptoms of asbestos-related diseases don't appear until decades after the initial exposure. It could take up to 50 years for asbestos-related fibers to be inhaled to cause lung damage. Workers who handled, cleaned and removed asbestos from their workplaces as well as spouses, children and others who were exposed to asbestos are at risk for developing mesothelioma.

As well as mesothelioma, other asbestos-related diseases include laryngeal cancer, lung cancer, peritoneal mesothelioma, and mesothelioma of the ovary. The most fatal mesothelioma type is ovarian cancer, but it's much less prevalent than mesothelioma in general. It is often diagnosed later than other kinds of mesothelioma because it is a cancer that develops in the tissue of the reproductive organs, and the symptoms may be similar to symptoms of other illnesses.

There were many companies that used asbestos in the 20th century, but they knew that it was dangerous. They exposed thousands of people to asbestos if they didn't eliminate it from their products. These people now are able to claim financial compensation. Many asbestos-related manufacturers are bankrupt. The victims can now seek compensation from trust funds created by bankruptcy courts.
